Employment-Based Immigration: first Preference EB-1

You might be eligible for an employment-based, first-preference visa if you are an alien of extraordinary capability, are an exceptional professor or scientist, or are a specific multinational executive or supervisor. Each occupational category has certain requirements that must be fulfilled:

Your petitioning company should be a U.S. employer and intend to employ you in a supervisory or executive capacity. The petitioner must have been doing service in the U.S. for at least 1 year, as a legal entity with a certifying relationship to the entity that employed you abroad in a supervisory or executive capacity.

* Criteria for Demonstrating Extraordinary Ability

In order to show you have sustained nationwide or global praise which your accomplishments have been acknowledged in your field of proficiency, you need to either consist of proof of a one-time achievement (significant internationally-recognized award) or 3 of the 10 noted criteria below (or comparable proof if any of the criteria do not readily use):

– Evidence of receipt of lesser nationally or internationally acknowledged rewards or awards for quality

– Evidence of your membership in associations in the field which demand impressive achievement of their members

– Evidence of published product about you in professional or significant trade publications or other significant media

– Evidence that you have actually been asked to evaluate the work of others, either individually or on a panel

– Evidence of your initial clinical, scholarly, creative, athletic, or business-related contributions of significant significance to the field

– Evidence of your authorship of scholarly articles in expert or significant trade publications or other major media

– Evidence that your work has actually been displayed at creative exhibitions or showcases

– Evidence of your performance of a leading or crucial function in distinguished companies

– Evidence that you command a high salary or other significantly high reimbursement in relation to others in the field

– Evidence of your business successes in the performing arts

** Examples of Documentary Evidence That a Person is an Exceptional Professor or Researcher

In order to demonstrate you are an exceptional professor or scientist, you must include proof of 2 of the 6 noted requirements below (or equivalent evidence if any of the requirements do not readily use):

– Evidence of receipt of major prizes or awards for outstanding achievement

– Evidence of membership in associations that need their members to demonstrate impressive accomplishment

– Evidence of published product in professional publications composed by others about the alien’s work in the academic field

– Evidence of participation, either on a panel or individually, as a judge of the work of others in the very same or allied scholastic field

– Evidence of original clinical or scholarly research study contributions in the field

– Evidence of authorship of academic books or articles (in scholarly journals with worldwide flow) in the field

Application Process

Extraordinary Ability: You may look for yourself by filing a Form I-140, Petition for Alien Worker.

Outstanding Professors and Researchers: Your U.S. need to submit a Type I-140, Petition for Alien Worker. As part of the application process, your employer needs to have the ability to show a continuing capability to pay the provided wage since the concern date. Your company may use an annual report, federal tax return, or audited monetary statement to show a continuing ability to pay your wage.

Multinational Manager or Executive: Your U.S. employer should submit USCIS Form I-140, Petition for Alien Worker. As part of the application process, your employer must be able to demonstrate a continuing ability to pay the provided wage since the priority date. Your employer might utilize a yearly report, federal earnings tax return, or audited monetary statement to show a continuing capability to pay your wage.
